TBR Powerup System Terms and Conditions

Introduction

The following Terms and Conditions control your membership in the TBR Powerup System program. You agree that you have read and understand this Agreement ("Agreement") and that your membership in the TBR Powerup System program (the "Program") shall be subject to the following Terms and Conditions between you (the "Member") and TBR Powerup System. These Terms and Conditions may be modified at any time by TBR Powerup System. Please review them from time to time since your ongoing use is subject to the terms and conditions as modified. Your continued participation in TBR Powerup System after such modification shall be deemed to be your acceptance of any such modification. If you do not agree to these Terms and Conditions, please do not register to become a member of TBR Powerup System.

Terms of Participation

Member must be 18 years of age or older to participate.

Members must provide TBR Powerup System with accurate, complete and updated registration information, including an accurate name, mailing address and email address.

To the full extent allowed by applicable law, TBR Powerup System at its sole discretion and for any or no reason may refuse to accept applications for membership.

Members may not:

• Activate or use more than one Member account
• Select or use an email address of another person
• Use a name subject to rights of another person without authorization
• Use a false or misleading name, mailing address, or email address

By signing up for the TBR Powerup System program, Member is opting-in to receive special offer emails from TBR Powerup System. You may cancel your account anytime to opt out.

TBR Powerup System reserves the right to track Member's activity by both IP Address and individual browser activity.

Member agrees not to abuse membership privileges, attempt to earn through illegitimate means, or participate in fraudulent activity.

TBR Powerup System shall be the sole determiner in cases of suspected abuse, fraud, or violations. Any decision regarding cancellation of earnings or membership termination is final.

Spamming is strictly prohibited. Any spamming to advertise TBR Powerup System will result in immediate account termination and forfeiture of balance.

Member is responsible for updating their contact information. Failure to do so may result in membership termination.

Member must comply with all applicable laws. Participation is only permitted where legal.

As this is a member-to-member payment program, all payments are non-refundable since you are paying another member to upgrade your account.

If you disagree with any Terms or updates, your only option is to discontinue use of the TBR Powerup System program and terminate your membership.

Disclaimers

MEMBER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT MEMBER'S SOLE RISK. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, TBR Powerup System DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TBR Powerup System MAKES NO WARRANTY REGARDING GOODS OR SERVICES OBTAINED THROUGH THE PROGRAM, OR TRANSACTIONS ENTERED THROUGH THE PROGRAM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TBR Powerup System AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICE, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TBR Powerup System implements standard industry measures such as firewalls, encryption, token authentication, and traffic monitoring to protect user data. However, no system is completely secure. Transmission of information is at your own risk.

This Agreement constitutes the entire understanding between you and TBR Powerup System. If any part is deemed unenforceable, it will be modified to the minimum extent necessary, and the remainder will remain in full force. Failure to enforce any provision is not a waiver of rights.
